1. Acceptance and Eligibility
These Terms of Use (“Terms”) are an agreement between you and Dispatch Training Center Inc. (“DTC,” “we,” “us,” or “our”). You must be at least 18 years old and able to enter a binding agreement, or participate with the authorization of a parent or legal guardian.
2. Educational Services
DTC provides live online and in-person education, digital or printed materials, consultations, and related resources concerning freight dispatch, trucking safety and compliance, IFTA, permits, and business operations. Program format, curriculum, dates, instructors, inclusions, prerequisites, and availability may vary and are described on the applicable program page, order page, or registration communication.
3. Registration, Pricing, and Payment
You agree to provide accurate, current registration and billing information and to pay all charges shown at checkout. Prices, promotions, payment schedules, taxes, and available payment methods may change before purchase. A registration is not complete until payment or another expressly approved arrangement is confirmed.
Payments may be processed by third-party providers. Their terms and privacy policies also apply to their services.
4. Schedules and Program Changes
We may reasonably change a class date, time, instructor, location, delivery method, or included resource when necessary. If DTC cancels or materially reschedules a paid program, we will provide the options communicated for that program, which may include transfer, credit, or refund as applicable.
5. Refunds, Guarantees, Cancellations, and Transfers
Any refund, satisfaction guarantee, retake discount, cancellation, rescheduling, or transfer terms displayed on the applicable program page or checkout at the time of purchase are incorporated into these Terms and control for that purchase. Requests must follow the stated time limits and instructions. Statutory rights that cannot be waived remain unaffected.
6. Student Conduct
You agree not to disrupt instruction, harass participants or staff, misuse access credentials, impersonate another person, record a session without written permission, introduce malicious code, or use our website or services unlawfully. We may remove a participant or restrict access when reasonably necessary to protect the class, DTC, or others.
7. Intellectual Property and Personal License
DTC and its licensors own the website, curriculum, recordings, presentations, workbooks, templates, graphics, branding, and other course materials, except where stated otherwise. A purchase grants you a limited, personal, non-exclusive, non-transferable license to use provided materials for your own learning and internal business reference.
You may not reproduce, sell, publish, upload, distribute, teach from, sublicense, share account access to, or create competing materials from DTC content without prior written permission, except as permitted by law.
8. No Professional Advice or Guaranteed Results
DTC provides education and general information. We do not provide legal, tax, accounting, insurance, investment, or individualized regulatory advice. Laws, agency guidance, market conditions, and business practices change, and you remain responsible for verifying current requirements and obtaining qualified professional advice when needed.
We do not guarantee employment, income, business formation, licensing, loads, rates, carrier growth, audit outcomes, compliance status, or any specific result. Testimonials describe individual experiences; your results depend on many factors and will vary.
9. Third-Party Services and Links
Our website and programs may reference or link to government agencies, software, load boards, payment services, vendors, and other third parties. DTC does not control and is not responsible for third-party content, availability, pricing, policies, or performance. A reference does not necessarily mean endorsement.
10. Disclaimers
To the fullest extent permitted by law, the website, programs, and materials are provided “as is” and “as available.” DTC disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted access or that every item of information will remain current or error-free. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
11. Limitation of Liability
To the fullest extent permitted by law, DTC and its officers, employees, instructors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, opportunities, or business interruption arising from the website, programs, or materials. Nothing in these Terms limits liability that cannot legally be limited.
12. Privacy
Our Privacy Policy explains how we handle personal information and is incorporated into these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction, subject to applicable law.
14. Changes and General Terms
We may update these Terms by posting a revised version and changing the effective date. Updated Terms apply prospectively unless otherwise stated. If one provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with applicable program-specific terms and our Privacy Policy, form the agreement concerning the covered services.
